What is a will?

A will is a legal document for disposing of property after death. In addition to specifying how you want your property to pass, an executor is appointed to administer your estate. If you have minor children, you can also appoint guardians for them.

Does the state get my property if I die without a will?

If you have no will when you die, your property passes according to the intestacy laws of the state of your residence. Your property is not passed to the state unless you have no will and no spouse, domestic partner, or living relatives when you die. If you die without a will and a probate is required, your estate administrator may be required to post a bond. If you have a will, you may dispense with the requirement of posting a bond.
